1. Acceptance of Terms

By accessing or using MowBoss ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by MowBoss ("we," "us," or "our").

2. Description of Service

MowBoss is a lawn care and landscaping business management platform that provides scheduling, invoicing, customer management, crew management, route optimization, estimating, and related tools for lawn care professionals.

3. Account Registration

• You must be at least 18 years old to use the Service.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity of the Service
• Upload malicious code, viruses, or harmful content
• Use automated systems (bots, scrapers) to access the Service without permission
• Resell or redistribute access to the Service without authorization

5. Your Data

You retain ownership of all data you enter into the Service ("Your Data"). You grant us a limited license to use, store, and process Your Data solely to provide the Service. We will handle Your Data in accordance with our Privacy Policy.

6. SMS/Text Messaging Program

MowBoss provides SMS text messaging notifications as part of the Service. You must explicitly opt in by checking the SMS consent checkbox when your phone number is collected. Consent to receive SMS notifications is not required to use our services or to make any purchase.

Program Details

• Program Name: MowBoss Service Notifications
• Program Description: Transactional and operational text messages for lawn care service management, including appointment scheduling confirmations, crew en-route notifications with live tracking, service completion alerts, phone verification codes, customer portal access links, review requests, estimates, payment reminders, and promotional messages.
• Message Frequency: Message frequency varies. You may receive multiple messages per service visit (scheduling confirmation, crew en-route alert, service completion notification). Typical frequency ranges from 1 to 10 messages per week depending on your service schedule.
• Message and Data Rates: Message and data rates may apply. Contact your wireless carrier for details about your messaging plan.

How to Opt In

You can opt in to receive SMS notifications from MowBoss by providing your phone number and explicitly checking the SMS consent checkbox when your phone number is collected. This may happen when:

• A lawn care business adds you as a customer in the MowBoss dashboard
• You submit an online booking request through a MowBoss-powered form
• You update your contact preferences in the customer portal

The consent checkbox is unchecked by default and is voluntary.

Opt-In Confirmation

After opting in, you will receive a confirmation SMS message:

Opt-Out & Help

• Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message from MowBoss. You will receive a one-time confirmation that you have been unsubscribed. After opting out, you will no longer receive SMS notifications. You may still receive service-related communications via email.
• Help: For assistance with MowBoss text messages, reply HELP to any message or contact our support team at support@mowboss.app.

Carriers & Privacy

• Supported Carriers: MowBoss SMS notifications are supported on all major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
• No Sharing of Opt-In Data: All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We do not sell, rent, or share phone numbers or SMS consent with third parties or affiliates for their own marketing purposes.
• SMS Service Provider: We use Twilio as our SMS service provider to deliver text messages. Phone numbers are shared with Twilio solely for the purpose of delivering messages on our behalf.

7. AI Features

The Service includes AI-powered features such as satellite property measurement, estimate generation, and social media post creation. These features are provided as tools to assist your business and should not be relied upon as the sole basis for business decisions. AI-generated measurements are estimates and should be verified independently for critical applications.

8. Payment Terms

• Subscription fees are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by law.
• We reserve the right to change pricing with 30 days notice.
• Your subscription will auto-renew unless cancelled before the renewal date.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or circumstances beyond our reasonable control.

10. Limitation of Liability

To the fullest extent permitted by law, MowBoss shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.

11. Termination

You may terminate your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period to allow for data export.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.
